1. Introduction Welcome to IbizaBeyond, the platform connecting you with luxury yacht charters and other exclusive experiences in Ibiza. By using our website or booking through our channels, you agree to the following Terms and Conditions.
2. Role of IbizaBeyond Intermediary: IbizaBeyond acts solely as an intermediary between the user and service providers (e.g., captains, boat owners). We are not responsible for: The direct management of the boats or services booked. Accidents, damages, or conduct of third-party providers. Any issues caused by third parties. User Responsibilities: Users are required to verify the credentials and licenses of providers (available upon request).
3. Bookings and Payments
- Booking Process: Select the boat, dates, and additional services (e.g., skipper, catering).
- Payment:
- A payment equal to 50% of the total amount is due at the time of booking.
- The remaining 50% of the total amount is due at the start of the charter.
- Payment Methods: Credit card.
- Electronic receipt sent automatically.
4. Cancellation Policy
- Cancellation by the Customer: Cancellations are accepted only within 72 hours of booking. After this period, the 50% of the total amount paid at booking is non-refundable. If canceled within 72 hours, the 50% payment made at booking will be fully refunded.
- Cancellation by IbizaBeyond: For reasons beyond our control (e.g., bad weather, boat unavailability): Full refund or rescheduling.
5. Liability and Limitations Customer Liability: The customer is responsible for damages caused by negligence (e.g., intentional damage to equipment). Must follow onboard safety rules communicated by the captain. Insurance: Boats are covered by mandatory liability insurance. Details are available upon request.
6. Privacy and Data Management Personal Data: We use user data (name, email, preferences) to: Process bookings. Send offers for additional services (e.g., villas, transport). Opt-out: Users can withdraw consent at any time. Sharing with Third Parties: Data is shared with providers only for operational purposes.
7. Disputes and Applicable Law Dispute Resolution: Mandatory mediation attempt before legal action. Jurisdiction: Courts of [Ibiza/Madrid], Spain. Applicable Law: Spanish law and EU regulations (e.g., GDPR, Digital Services Act).
